Haven't been on jury duty for about 3 years. I'll check with a court officer friend to see what the law here in jersey is.

Frank and Mikey, more correctly Mikey should have said that I come off as a pompous ass. In fact I am not. This is a technical business.

I consider you calling me a pompous ass laughable. A basic brother transplanted to the South Side? You should see how often I scratch and 'readjust' myself. My vocabulary is too snooty? Do you realize how many times I say 'got'? I do tend to say "one" instead of "you" to keep from personalizing comments.

I'm not goin' to dumb down for anyone, that would be presumptuous. Long ago, I decided to have one type of language around everyone (not all people do this). I don't try to make anyone run to the dictionary but I have friends that do.

Anyway, ease up on me! This is not about me. Whether I'm snobby or not is irrelevant. Stick to the point or soon we'll be talking about each others' mommas.

I tried posting this history on another thread but this bloody message composer ate it just as I finished. This is my second, and last, attempt. Worse, there is no way to get around the composer since there is no way to compose using a word processing program and then cut and paste it to the message composer, (or is there)?

The Supreme Court didn't start out having the authority to interpret the Constitution. They assumed that authority as a subset of their assumption of their right to nullify laws and court decisions on the basis of the doctrine of "unconstitutionality", a doctrine that they invented themselves in 1803 in the case of Marbury v. Madison. It was a crude, and obvious, political maneuver on the part of Chief Justice Marshall to extend his authority to the areas of government denied him, the Executive and Legislative branch. However, it served the pragmatic needs of the politicians in power at the time, so they let it stand. The bastardized Constitution that we have today is a product of two hundred years of interpretation of the Constitution without any inherent Constitutional authority to do so.

The inferential power that Marshall "saw" in the Constitution is there in like measure for the Executive and Legislative branch, if they wanted to use it. Andrew Jackson did when he nullified the Supreme Court's nullification of Georgia's decision to expel the Cherokee indians from their reservation lands because gold was discovered therein and they wanted to steal it. An appropriate Legislative response to this would have been to affirm either the Supreme Court or Jackson, in keeping with the intent of the tripartite division of powers. However, by doing nothing, they tacitly affirmed Jackson while not ovetly screwing the Cherokees.

Ever since, the Executive and Legislative branches have been happy to let the Judiciary have the final word on all matters political because it enables them to avoid pissing off the people they would decide against. They can simply claim to the losers that it is out of their hands, but that, were it not, they would certainly side with them, while telling the winners that they agree with the Supreme Court.

After 130 years, this hands-off, impotent policy came to full fruition with the Supreme Court of the 'sixties. Affirmative action and busing destroyed the unity of the Democratic Party, changing it into the de facto party of The Blacks. Whites deserted in droves to the Republican Party, which offered them nothing except the hope of paying less for civil services that their progeny would never be allowed to join, and services that only served minority interests. Meanwhile, the Republicans were happy to allow Affirmative Action to flourish because it divided the Democrats.

Today's America, where the stupendously wealthy control everything; where virtually all American industry has been shipped to China, and were all of America's wealth has been made portable, is a direct result of unrestrained Judicial omnipotence.

People of every race, color, and creed who are NOT stupendously wealthy have no reason to join the Republican Party. The Republicans' primary interest, (dictated by the people who fund them), is preserving and augmenting the wealth of the heriditary stupendously wealthy. And there is no unified opposition to them because the constituency that would naturally form the Democratic party has been pitted against others in their class who are of a different race instead of against the stupendously wealthy. This invidious process has resulted in the stupendously wealthy controlling the Democratic Party as well. Who, in the 'sixties, could have believed that a Democratic candidate who was a centimillionaire would run on a platform that envisaged the continuation of the export of our patrimony to Asia? The fact is that every politician votes in the way dictated by those who bankroll his candidacy. Middle class Whites view the Democrats with the same distaste that they view the Republicans, but at least the Republicans are nominally opposed to screwing their children. On the other hand, they are certainly not going to give either of them any money. Campaign contributions come from individuals, interest groups, and PAC's which, in reality, are composed almost entirely of the same stupendously wealthy folks and their Beards.

Hey Nucky I would venture to say that I understand far more "vocabulary" than you do..my Pompous ass statement wasn't reagrding your use of " big words. I understand and comprehend very well. I can use big words If I choose to...I think you are a pompous ass because you are one in my eyes. You seem to feel the need to point out errors in the use of language . Most of us here don't do that. We are smarter than that...and smarter than you .

Yogi, I cut and paste all the time. From AOL e-mails, from Outlook e-mails, and it seems the only thing I can't cut/copy and paste are pictures ans supposedly this forum doesn't allow jpg or gif files.

Mikey, I think you are a purple cow because you are one in my eyes. Now, should I expect milk anytime soon?

I've not pointed out errors in people's use of language because its too easy to make mistakes typing. I've pointed out errors in reasoning in the polite discourse on this board.
